PLEASE READ THIS PRIVACY POLICY CAREFULLY TO UNDERSTAND ACTIVE4.ME'S POLICIES AND PRACTICES REGARDING YOU OR YOUR CHILD'S INFORMATION AND HOW THE INFORMATION COLLECTED WILL BE TREATED.

If you do not agree with Active4.me's policies and practices, do not register to participate in the Program, or use the Website, any related applications, or services. This Privacy Policy is incorporated by reference into and forms a part of Active4.me's Terms of Service. Please read this policy carefully to understand Active4.me's policies and practices regarding you and your child's information and how the information collected will be treated. By accessing or using the Website, you agree to this Privacy Policy. This policy may change from time to time. Your continued use of the Program after changes are made is deemed to be acceptance of those changes, therefore, you should check the policy periodically for updates.

Who Are We?

Active4me, Inc., a California corporation ("Active4me"). Active4me's "Program" includes two components: (i) the data collected directly related to the student's activity, and (ii) Active4me's proprietary online content, functionality and services offered on or via downloadable applications and the website (collectively referred to as the "Website").

Active4me respects your privacy and the privacy of your children. Active4me is committed to protecting the privacy of it's participants through compliance with state and federal privacy laws, including Family Educational Rights and Privacy Act ("FERPA"), Children's Online Privacy Protection Act ("COPPA"), California's Student Online Personal Information Protection Act ("SOPIPA"), and other related industry standards.

Active4.me is a service that encourages physical activity and gives program managers easy to use tools to track their program's effectiveness. Active4me use simple, inexpensive web, app and barcode technology to capture laps around a track and other self reported activities.

This policy describes the types of information Active4me may collect from you (or your child) or that you may provide when you visit www.getrunclub.com and/or use various aspect of the Program and its practices for collecting, using, maintaining, protecting, and disclosing that information.

Australian Privacy Act. Where Active4me collects personal information from individuals located in Australia in the course of carrying on its business, Active4me is committed to complying with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Individuals in Australia who have a concern or complaint about the way Active4me has handled their personal information may contact Active4me at info@getrunclub.com in the first instance. If your concern is not resolved to your satisfaction, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.


1. Where Active4me Collects Information.

This policy applies to information Active4me collects:
  • On the Website.
  • Through mobile and desktop applications, which provide dedicated non-browser-based interaction between you and the Website.
  • When you interact with our applications on third-party websites and services, if those applications include links to this policy.
  • Users information through the scanned barcode tags (see Section 6).
  • Users information imported from Program Administrator files.

2. When Active4me Collects Information.

Active4me collects this information:
  • Directly from you when you provide it to us (ie: the website, signed documents, barcode tags).
  • From school's Program Administrators and other school personnel authorized by your (or your child’s) school.

3. Unsolicited Personal Information

Occasionally, Active4me may receive personal information that it did not request — for example, if a parent or administrator includes additional details in correspondence that were not required for participation in the program.

When this occurs, Active4me will promptly assess whether the information is of a kind that Active4me could have collected in the ordinary course of operating the program. If the information could have been legitimately collected, it will be handled in accordance with this Privacy Policy. If the information could not have been legitimately collected, Active4me will, as soon as practicable, destroy the information or ensure it is de-identified, provided it is lawful and reasonable to do so.


4. Information You Submit.

For children, including those under 13 years of age (except where noted), Active4me may collect the following information through a user’s (or Program Administrator’s) submission of it:

Notice of collection. When Active4me collects personal information from you or your child, we do so as described in this policy. Active4me, Inc. (PO Box 73311, Davis CA 95617; info@getrunclub.com) is the entity collecting this information. Personal information is collected for the purposes described in Section 9 of this policy. The provision of most personal information is voluntary — fields such as student name, grade, and parent email are optional, and the program can function using auto-generated identifiers in place of any personal details. Where information is not provided, the consequence may be that certain features — such as emailed progress reports or personalised activity reports — are unavailable. Active4me does not collect personal information from children under 13 directly; collection from or about children is conducted through the school's program administrator acting under parental consent obtained in accordance with Section 5 of this policy.

  • Teacher name (optional)
  • Grade level (optional)
  • Email address (except for children under 13)
  • Parent’s e-mail address (optional)
  • Number of laps or distance run or walked at school, and date and time of completion of the lap, in connection with school administered programs, and distance logged (on individual days and in the aggregate)
  • Virtual activities completed at home (optional)

There are a number of ways you can provide this information to Active4me, including:
  • By filling in forms on the Website. This information includes information provided at the time of registering to use the Website, subscribing to the Service, posting material or requesting further services.
  • Active4me may also ask you for information when you enter a contest, competition or promotion, and when you report a problem with the Website.
  • Records and copies of your correspondence (including e-mail addresses), if you contact Active4me.
  • Details of transactions you carry out through the Website.
  • Your search queries on the Website.
  • Scans of the provided barcode tags.

Active4me does not condition a child's participation in the Program and online activity on the child providing more personal information than is reasonably necessary for that activity.

Active4me does not collect educational records, except the name of you or your child's teacher and school to allow data to be collected and organized for educational purposes as the Program Administrator sees fit.


5. Parental Consent for Children Under the Age of 13

Active4me requires consent from a parent or legal guardian when a child under 13 years of age wants to use or register with the Website. Parental consent is required from the child’s parent and can be provided to Active4me by either of the following methods:

  • Electronic submission through the Website followed by a physical paper form signed by the parent and delivered to the authorized program administrator for the child’s school (the “Program Administrator”). Electronic submissions not confirmed by receipt of the follow-up signed physical paper form within 30 days of electronic submission will by automatically deleted; or
  • A physical paper form signed by the parent and delivered to a Program Administrator who will then input it to our database.

6. Barcode Tags

Children (including children under 13) may receive a barcode tag, which becomes affiliated with their user name, and may be used by personnel authorized by the school to track and correlate to information about that child. Lost barcode tags should be reported to Active4me immediately at info@getrunclub.com. For security purposes of the child's information, the barcode tag itself will not access personal information. Personal information about the parent and the child can only be accessed by the Program Administrator with specific “user” access permissions.


7. Accessing the Website

Active4me's Privacy Policy is incorporated into the Terms of Service by reference https://www.getrunclub.com/Terms. Active4me cannot guarantee that all aspects of the Website will be up and running 24/7. Active4me reserve the right to suspend or restrict access to specific features by user. Active4me will not be liable in the event that all or part of the Website is unavailable at any time or for any period. Active4me is not liable for any data loss. Active4me does not represent that the content provided on the Website will be error free. Access to certain features of the website will be controlled through a unique URL sent by the program administer by email. This URL will contain a temporary unique 'key' that will enable access for up to 30 days.


8. Usage Details, IP Addresses, Cookies and Other Technologies

As you interact with the Website, Active4me may automatically collect certain information about your equipment, browsing actions and patterns, including:

  • Details of your visits to the Website, including traffic data, location data, logs and other communication data, pages requested and the resources that you access and use on the Website.
  • Information about your computer and Internet connection, including your IP address, operating system, browser type and information regarding the Internet service provider.

The information Active4me collects automatically is statistical data, and does not identify any individual. It helps Active4me to improve the Website and to deliver a better and more personalized service by enabling Active4me to:

  • Estimate the audience size and usage patterns.
  • Store information about your preferences, allowing Active4me to customize the Website according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to the Website.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Website. Unless you have adjusted your browser setting so that it will refuse cookies, the system will issue cookies when you direct your browser to the Website.
  • Web Beacons. Pages of the Website and Active4me's e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit Active4me , for example, to count users who have visited those pages or opened an e-mail and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity). Active4me does not collect personal information automatically, but may tie this information to personal information about you that has been collected from other sources or you provide to Active4me.

9. How Active4me Uses Your Information

Active4me uses information that is collected about you or that you provide to Active4me, including any personal information:

  • To present the Website and its contents to you.
  • To provide you with information, products or services that you request from Active4me.
  • To provide you with notices about your account, including expiration and renewal notices.
  • To notify users of contest results or contest updates.
  • Individual user/student statistics can optionally be viewed remotely ONLY by that student with a unique URL that expires after 30 days. Program administrators can optionally print this same report for each student.
  • To notify you about changes to the Website or any products or services Active4me offers.
  • To allow you to participate in interactive features on the Website.
  • To ensure users are following the Website’s Terms of Use.
  • To ban a user temporarily or permanently from the Website if that user engages in inappropriate conduct on the Website.
  • To enable review of your (or your child’s) personal information that has been submitted to the Website and to provide notification regarding the Website, such as any future amendments to this Privacy Policy.
  • In any other way Active4me may describe at the time that you provide the information to Active4me.
  • For any other purpose with your consent.
  • For Program Administrators to notify parents or users over 13 years of age by e-mail about program updates/changes, contests or system problems.

10. Student Marketing and Advertising Restrictions.

Active4me does not use you or your child's personally identifiable information in any marketing activities without prior approval from both the school's Program Administrator and the parent of the child (ie: student recognition programs or fundraising programs). Active4me does not use the data collected from use of the Website or the Program to target ads.


11. Disclosure of Personally Identifiable Information

Active4me may disclose personal information that is collected or you provide as described in this Privacy Policy:

  • To the school’s Program Administrators for your (or your child’s) school.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of the Active4me's assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by Active4me about the Website users is among the assets transferred. Any buyer or successor will be bound by the same privacy terms.
  • To fulfill the purpose for which you (or your parent) provide it.
  • For any other purpose disclosed by Active4me when you provide the information.
  • With your consent (or with parental consent for children under 13).
  • To enforce or apply Active4me's Terms of Use, Terms of Sale and other agreements.
  • To comply with any court order, law or legal process, including to respond to any government or regulatory request.
  • To the extent required by applicable law, in response to a law enforcement agency's or other government agency's (including schools or children services) request or if Active4me's feels that such disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using the Website, protect the security or integrity of the Website, or enable Active4me to take precautions against liability.
  • To the following third-party service providers we use to operate the Program. Each provider is contractually bound to protect student data, keep it confidential, and use it solely for the purpose of providing services to Active4me:

    Active4me does not permit these service providers to use student data for any purpose other than providing services to Active4me. A current list of subprocessors is maintained here and will be updated as providers change. Active4me will notify the school district of any material changes to subprocessors.

Parents of children under the age of 13 may refuse to allow Active4me to provide their child’s personal information to third parties; provided, however, it may not be possible for Active4me to provide the services to you or your child if Active4me cannot provide information to the contracted service providers, such as the hosting company. To inform Active4me that you do not want Active4me to share your child’s information with third parties, please email info@getrunclub.com.


12. Cross-Border Disclosure (Australian Privacy Act)

Active4me uses cloud infrastructure and backup services operated by Amazon Web Services, Inc. with data centres located in the United States, Ireland, the United Kingdom, and Australia. Personal information, in encrypted form, may be stored in or transferred to these locations as part of our standard backup and disaster-recovery operations. Before disclosing personal information to overseas recipients, Active4me takes reasonable steps to ensure that those recipients are bound by privacy obligations that are substantially similar to the Australian Privacy Principles under the Privacy Act 1988 (Cth). These steps include entering into Data Processing Agreements with each subprocessor that contractually require them to handle personal information in a manner consistent with applicable privacy law, to implement appropriate technical and organisational security measures, and to use personal information solely for the purpose of providing services to Active4me.

By providing personal information to Active4me, or by authorising a school or program administrator to do so, you acknowledge that personal information may be transferred to and stored in countries outside Australia. Where such transfer occurs, Active4me remains accountable for ensuring that the overseas recipient handles personal information in accordance with the obligations set out in this Privacy Policy.


13. Disclosure of Non-Personally Identifiable Information.

Active4me may disclose information that does not personally identify any individual without restriction.


14. Access to Information; Correction, Redaction, or Deletion of Information; Objection to Information Collection and Retention; Other Choices.

Active4me allows you to access, inspect, review, and correct the information and data collected online from you or your child. To request access to, correction of, or deletion of personal information, please contact Active4me at info@getrunclub.com. Please include your name, email address, and a telephone number where we can reach you, together with a description of your request.

Active4me will respond to access and correction requests within a reasonable time, and in any event within 30 days of receipt. Access will be provided in a format that is reasonable in the circumstances. In some limited cases, Active4me may decline to provide access — for example, where doing so would unreasonably affect the privacy of another individual, where a legal exception applies, or where the request is frivolous. If access is refused, Active4me will provide written reasons for the refusal and advise of any available avenues of complaint. Where Active4me corrects personal information that has previously been disclosed to a third party (such as a school program administrator or a subprocessor), Active4me will take reasonable steps to notify that third party of the correction, where it is practicable and lawful to do so.

If Active4me declines to correct personal information as requested, Active4me will notify you of the refusal and the reasons for it, and will advise you of mechanisms available to complain about the refusal, including to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au where the Australian Privacy Act applies.

Please be aware that redaction of data may not be available without complete deletion, and deletion of data may lead to the termination of your Active4me account, membership and/or service.


15. SOPIPA Compliance Overview.

In compliance with SOPIPA, Active4me does not use the information to develop student profiles for any student for non-K-12 school purposes, or sell collected information to third-parties (except as part of a merger or business sale). Further, Active4me does not knowingly engage in targeted advertising to students or their parents or legal guardians and actively takes steps to prevent these actions.

Further, Active4me implements and maintains reasonable security procedures and practices to protect the collected information from unauthorized access, destruction, use, modification or disclosure, and has a process in place to request deletion of student's information. At the request of the participating school or school district, all student information, including your or your student's information, will be deleted.

Quality of personal information. Active4me takes reasonable steps to ensure that the personal information it holds is accurate, up to date, and complete, having regard to the purpose for which it is held. Because most student data is provided by school program administrators, Active4me relies on administrators to supply accurate information and to notify Active4me of any changes. If you believe that personal information Active4me holds about you or your child is inaccurate or out of date, please contact us as described in Section 14 so that we can correct it promptly.


16. Data Security

Security Framework: Active4.me implements security practices aligned with the CIS Critical Security Controls (CIS Controls), a globally recognized cybersecurity framework developed by the Center for Internet Security. These controls guide our approach to protecting the personal information we collect and process on behalf of schools, administrators, and students.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Website, you are responsible for keeping this password confidential. Active4me asks that you not to share your account or password with anyone. Active4me asks that you please notify Active4me of any potential breach of security that may relate to your account or the password provided to you by the Program Administrator.

Unfortunately, the transmission of information via the Internet is never completely secure, and all such transmission is at your risk. Although Active4me does its best to protect your personal information, Active4me cannot guarantee the security of your personal information transmitted to the Website. Active4me is not responsible for circumvention of any privacy settings or security measures contained on the Website. The Website may contain links to other sites and Active4me is not responsible for the privacy policies and/or practices on other websites. Please check the privacy policy of the third-party site immediately upon accessing the site.


17. Data Retention

We retain personal information only for as long as necessary to provide our services and fulfill the purposes outlined in this Privacy Policy, or as required by applicable law.

Active Account Data. Personal information associated with an active student account — including, where voluntarily provided, student name, teacher, grade, parent email address, and student email address (for students age 13 and older) — is retained for the duration of the account's active status.

Account Deletion and Expiration. When a student account is deleted by an administrator or authorized user, or when an account expires due to inactivity or the conclusion of a program term, the associated personal information is scheduled for permanent deletion. Such data is permanently and irreversibly deleted from our systems within ninety (90) days of the deletion or expiration date.

Encrypted Backup Retention. As part of our standard security and disaster recovery practices, we maintain encrypted database backups for a period of up to six (6) months. These backups are automatically and permanently purged upon the expiration of that retention period. Personal information contained in encrypted backups may persist for up to six (6) months following account deletion or expiration, after which it is permanently deleted in the ordinary course of our backup purge cycle.

No Sale or Transfer of Student Data. We do not sell, rent, or otherwise transfer student personal information to third parties for commercial purposes. Retention of student data is solely for the purpose of providing and improving our services to schools and administrators.

Requests for Early Deletion. Schools or authorized administrators may request the deletion of student personal information prior to the expiration of the applicable retention period by contacting us at info@getrunclub.com. We will honor such requests in accordance with applicable law, including the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA), where applicable.


18. Changes to Active4me's Privacy Policy

Active4me may amend this Privacy Policy from time to time. It is Active4me's policy to post any changes made to the Privacy Policy on this page with a notice that the Privacy Policy has been updated on the Website home page. If Active4me makes material changes to how users' personal information will be treated, Active4me will notify you by e-mail to the e-mail address specified in your account. You are responsible for ensuring your account is up-to-date with an active and deliverable e-mail address that contacts you directly, and for periodically visiting the Website and this Privacy Policy to check for any changes. The date the Privacy Policy was last revised is identified at the top of the page. You are bound by any changes to the Privacy Policy when you use the Website after such changes have been first posted, and, if material, you’ve received notice.
